ArgumentIn the United States, scientific knowledge is brought before the courts by way of testimony – the testimony of scientific experts. We argue that this expertise is best understoodfirstas related to the quality of the underlying scienceand thenin terms of who delivers it. Bloodstain pattern analysis (BPA), a contemporary forensic science, serves as the vaulting point for our exploration of objectivity as a metric for the quality of a science in judicial contexts. We argue that BPA fails to meet the (...) minimal standard set by Helen Longino’s social-procedural account of objectivity (1990, 2002). In light of some pressing issues for social-procedural accounts, we offer an infrastructural account of objectivity. This account offers what amounts to a friendly amendment to Longino’s account and adds to the ways in which we might analyze social-procedural objectivity. Finally, we address an issue that is pressing in the legal context: given that scientific knowledge is delivered by individuals, not communities, at least in U.S. courts, we (may) need a way to evaluate individual scientific and epistemic agents. We suggest a means for making this evaluation that is derived from our infrastructural account of objectivity. (shrink)

This is the first full-length biography of John Langshaw Austin (1911–60). The opening four chapters outline his origins, childhood, schooling, and time as an undergraduate, while the next four examine his early career in professional philosophy, looking at the influence of Oxford Realism, Logical Positivism, Pragmatism, and the later Wittgenstein. The central twelve chapters then explore Austin’s wartime career in British Intelligence. The first three examine the contributions he made to the campaigns in North Africa; the next seven the seminal (...) role he played in ensuring the outstanding accuracy of the D-Day Intelligence; while the final two explore his contributions to Arnhem, the Ardennes, and the post-war administration of Germany. The last main section of the book then outlines and assesses Austin’s contributions to post-war Oxford Ordinary Language Philosophy. The first three chapters discuss the impact on Oxford philosophy of the cultural atmosphere of post-war Britain and the later Wittgenstein’s ideas. The next four look at Austin’s influence on post-war Oxford, particularly his Saturday morning discussion group and his perception lectures. The next five chapters concentrate on America’s influence on Austin and vice versa, paying particular attention to Austin’s work on speech-acts and his semesters in Harvard and Berkeley. The final two chapters examine Austin’s declining influence in Oxford, and his tragically premature death. (shrink)

An attitude which hopes to derive aesthetic pleasure from an object is often thought to be in tension with an attitude which hopes to derive knowledge from it. The current article argues that this alleged conflict only makes sense when the aesthetic attitude and knowledge are construed unnaturally narrowly, and that when both are correctly understood there is no tension between them. To do this, the article first proposes a broad and satisfying account of the aesthetic attitude, and then considers (...) and rejects twelve reasons for thinking that deriving knowledge from something is incompatible with maintaining an aesthetic attitude towards it. Two main conclusions are drawn. 1) That the representational arts are often in a good position to communicate non-propositional knowledge about human beings. 2) That while our desire to obtain pleasure from a work's manifest properties, and our desire to obtain knowledge from it, are not the same motive, the formal similarities between them are sufficiently impressive to warrant both being seen as elements of the aesthetic attitude. After presenting a variety of arguments in support of the idea that ordinary names are indexical, I respond to John Perry's recent arguments against the indexicality of names. I conclude by indicating some connections between the theory of names defended here and Wittgenstein's observations on naming, and suggest that the latter may have been misconstrued in the literature.

Caper in his section on the preposition ex cited Ennius, Ann. 309:nauibus explebant sese terrasque replebant,and declared that Virgil used the verb with this antique sense in Aen. 6, 545:discedam; explebo numerum reddarque tenebris,i.e. ‘minuam vestrum numerum.’This we are told in Servius' note, which begins: Ut diximus supra, explebo est minuam. Thilo gives no reference to any such previous words of Servius, and I have failed to find them. Can it be that Servius has carelessly transcribed a note of Donatus, (...) and that Donatus had discussed ex minuens at Geo. 2, 65, or 4, 145? Donatus' note on Terence, Hec. 755, is Explere exinanire Terentianum est; the passage of Terence is:eas ad mulieres huc intro atque istuc iusiurandum idempolliceare illis: exple animum îs teque hoc crimine expedi,i.e., relieve their mind of suspicion against Pamphilus and free yourself from this charge. The phrase recurs in the next Scene :illis modo explete animum.i atque exple animum îs, coge ut credant. (shrink)

The concept of supererogation is an act that it is right to do but not wrong not to do. The moral trinity of the deontic logic excludes such acts from moral theory. A moral theory that is based on duty or obligation unqualified seems inevitably to make all good acts obligations, whether construed from a teleological or deontological point of view. If supererogation is a moral fact, no moral theory can survive without acknowledging it. One way to distinguish supererogation from (...) obligation that is not arbitrary is to draw the line of obligation at death and dismemberment. Such a limit to obligation is often implicit in moral theory. Inclusive obligation requires us all to be heroes all of the time. The moral limit to obligation is one of Hobbes's teachings. Though it is seldom noted in contemporary political and moral theory, it is, for example, implied in Rawls's definition of ‘supererogation.’ In this definition it is said that heroic supererogation would be a duty but for the high cost associated with it. This cost is the risk of life and limb;.it distinguishes supererogation from both benevolence and obligation.A supererogation is a good act with a high cost. The goodness of the act, however determined, must be proportionate to the cost to the agent. If life is risked, life or something deemed no less valuable must be gained. The intention to effect such important goods for others is sufficient for an act to be supererogatory even if it fails.If moral reality is inevitably vague, complex, and incomplete, then it is no surprise that moral theory is that way, too. The challenge is that moral theory be no more vague, complex, and incomplete than necessary and in ways justified by the nature of moral reality. A science, Aristotle advised, can be no more precise than its subject matter permits. (shrink)

In Fiction, Truth and Literature, Lamarque and Olsen argue that if a critic claims or attempts to prove that the outlook of a work of literature is true or false, he is not engaging in literary or aesthetic appreciation. This paper argues against this position by adducing cases where literary critics discuss the truth or falsity of a work’s view, when their opinions are obviously relevant to the work’s aesthetic assessment. The paper considers in detail the way factual errors damage (...) a work’s aesthetic standing, and shows that Lamarque and Olsen’s alternative account of the role of propositional truths in literature only looks plausible because it considers a restricted range of examples. Finally, it considers the role intention, date and genre play in discussions of the aesthetic damage done by literal falsehood. (shrink)

Professor Postgate speaks of ‘the regrettable silence of the principal editors of Plautus upon the subject.’ As a minor editor, I beg to defend my colleagues by pointing out that the scansions dĭŭtíus and dyūtius are subject of a note in Dziatzko's and Hauler's editions of the Phormio of Terence and in the Plautus Report in Bursian of 1879 . Also that a reference to the index of my larger edition of the Captiui will show that the word is discussed (...) in my section on Prosody : ‘The same doubt exists regarding the scansion of diutius , the by-form of the fuller form dĭūtĭŭs .’. Work with plant cell cultures has developed rapidly in recent years, progress being manifested particularly by the development of commercial process technology for the synthesis of selected natural products. The economics of operating a plant‐cell culture process are, however, still questionable, and a great deal still needs to be done to strengthen the underlying science before the technology can be regarded as industrially commonplace. Nonetheless, the great versatility of plants as centres of chemical synthesis suggests that, with appropriate developments in (...) cell culture technology, this area may have a significant role to play in the fine chemicals industry of the future. Charisivs, in his chapter on Adverbs, cites for Hispane a line of Ennius' Annals : Hispane, non Romane memoretis loqui me. Professor Norden , the apostle of Combinations-forschung, combines this fact with another fact mentioned by Livy , the celebre per Hispaniam responsum of a Spanish town to a Roman embassy. But why does he ignore a third fact which must be brought into any combination that can be convincing—the quotation of this line of Ennius by Festus in a paragraph (...) which apparently deals with Graeco-Roman affinities ? With regard to the question whether “the holy ones” means divine powers or some category of Israelites, we militate for the latter interpretation. The psalmist addresses himself to God and those with whom he shares the land. From this position, principally chosen, he begins to meditate on his heritage.Part II shows that in the (...) corpus of the psalm, v.4bc-10, the theme “heritage” is developed in such a way that God's vicinity appears to be its fundamental value. This transposition makes it possible that the most threatening aspect of our earthly existence comes up: death. The psalmist draws the utmost consequences from God's vicinity. Since there is no limit to the length of God's protection, he is safe even from the Sheol.In Part III then we see that the praying person, carried by his personal growth, expresses in v. 11 the hope for an unassailable happiness of life, also for others. The X-ray and bulk densities of PdIn alloys have been determined at ambient temperature on samples annealed at 1273 and 1373 K and quenched in water-ice mixtures. From these measurements the vacancy concentrations in this intermetallic phase have been obtained as a function of In concentration at these two temperatures. In addition, a generalized thermodynamic model is presented which considers the existence of antisite and vacancy defects on both sublattices without any dilute solution approximations. This model uses three energy parameters, (...) whose values have been obtained for PdIn using the measured vacancy concentrations and the chemical potentials of In. This model is able to describe all the available vacancy data and is suitable for calculating these values at compositions and temperatures when such data are not available. In addition, the model permits the calculation of the concentrations of the minority point defects. It is shown that dilute-solution approximations, which have invariably been used in this kind of modelling, are unsatisfactory. The present results and their analysis confirm that PdIn is a near-triple-defect type of intermetallic and not a near-Schottky type, as has been claimed recently. (shrink)
